California Privacy Rights

This California Privacy Notice (“Notice”) supplements the website Privacy Policy provided by Luxe Connection, Luxe Connection.net operators, owners, agent/ brokers, or affiliates (“LuxeConnection.net”, “us”, “we”, or “our”). This Notice is provided pursuant to the California Consumer Privacy Act (the “CCPA”) and applies to “Consumers” as defined by the CCPA. 

Additional privacy notices apply to the personal information we collect from our website visitors, clients or customers. You may click here to view our Privacy Policy. If there is a conflict between any other policy, statement, or notice and this Notice, this Notice controls as to California Consumers.

This Notice covers the collection, use, disclosure, and sale of California Consumers’ “Personal Information” “Personally Identifiable Information,” (“PI”) or (“PII”) as defined by the CCPA, except to the extent such Personal Information (PI) is exempt from the notice obligations of the CCPA. This Notice also covers rights California Consumers have under the CCPA. 

1. Personal information (PI) We Collect

“Personal Information” “Personally Identifiable Information,” (“PI”) or (“PII”) is information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you. Personal Information does not include information that is publicly available, de-identified, or aggregated. Note that the Personal Information (PI) we collect about Consumers may vary depending on the nature of their interactions with us and may not include all the examples listed below.

Within the past 12 months, we collected, retained, used, and disclosed the following categories of Personal Information (PI) about California Consumers: 

Identifiers

  • This may include but is not limited to, a real name, alias, postal address, unique personal identifier, online identifier, internet protocol address, email address, account name, or other similar identifiers.

Personal Records under Cal. Civ. Code § 1798.80(e)

  • This may include information such as: physical characteristics or description, telephone number, education, employment, or employment history. 

Characteristics of Protected Classifications under California or federal law

  • This may include, but is not limited to, date of birth, place of birth, citizenship, residency, sex, marital status, religion, familial status, disability, gender identity, national origin, and languages.

Commercial Information

  • This may include, but is not limited to, records of personal property; products or services purchased, obtained, or considered; or other purchasing or consuming histories or tendencies, estimated net worth, estimated home value, flying habits and preferences, dietary preferences, ground and hotel preferences.

Internet Usage or Other Electronic Network Activity Information

  • This may include, but is not limited to, browsing history, search history, and information regarding your interaction with an internet website, application, or advertisement.

Geolocation Data

  • This may include, but is not limited to, physical location or movements and travel patterns.

Professional or Employment-Related Information

  • This may include, but is not limited to, professional, educational, or employment-related information.

Inferences 

  • Inferences drawn from other Personal Information we collect may be used to create a profile reflecting the consumer’s preferences, characteristics, psychological trends, predispositions, behavior, and attitudes. 

Sensitive Personal Information

  • This may include, but is not limited to, Personal Information that reveals a Consumer’s racial or ethnic origin, or religious or philosophical beliefs.

A. Sources  of Personal Information

We may have collected categories of PI described above directly from you or from data related to services provided to you, your devices, other consumers, service providers such as joint marketing providers, and network security vendors, data providers, affiliates, as well as public sources of data such as government databases. B. Use of Personal Information

Generally, we collect, retain, use, and disclose categories of PI described above to communicate with you directly and/ or provide you services and as otherwise related to the operation of our business, which includes the following business purposes:

  • to fulfill your requests
  • to answer your questions or respond to your feedback;
  • for statistical analysis
  • to inform you of changes to this Privacy Policy or our Terms of Use (Terms and Conditions)
  • to provide you with the Service;
  • to evaluate the security and stability of the Service;
  • to improve the Service
  • to send marketing offers and targeted advertising;
  • to make analyses in order to provide you with relevant marketing offers, event notifications, and information
  • to send you surveys to give you a possibility to influence our offers and services;
  • to enforce our Terms of Use or to protect us or others;
  • to qualify prospective customers; and
  • as otherwise permitted or required by applicable law.

2. Sharing of Personal Information (PI)

In the past 12 months we may have disclosed PI to our service providers, other vendors (including those that facilitate interest-based and other advertising and marketing) and our affiliates for the following business purposes: 

  • Performing services on our behalf
  • Auditing related to ad impressions
  • Ensuring security and integrity of Personal Information
  • Debugging to identify and repair errors that impair existing intended functionality
  • Short-term, transient use, including, but not limited to, non-personalized advertising
  • Providing advertising and marketing services (except for cross-context behavioral advertising)
  • Undertaking internal research for technological development and demonstration
  • Undertaking activities to verify or maintain the quality or safety of a service or device that is owned, manufactured, manufactured for, or controlled by us
  • Processing, maintaining, or collecting Personal Information on our behalf
  • Detecting or protecting against malicious, deceptive, fraudulent or illegal activity and
  • For internal use by the service provider.

Generally, we disclose the following categories of Personal Information (PI) for the business purposes listed above:

  • Identifiers;
  • Personal Information described in Cal. Civ. Code § 1798.80(e)
  • Characteristics of protected classifications
  • Commercial Information
  • Internet Usage or Other Electronic Network Activity Information
  • Geolocation Data
  • Professional or Employment-Related Information
  • Inferences
  • Sensitive Personal Information

We do not use or disclose Sensitive PI for purposes to which the right to limit use and disclosure applies under the CCPA.

Although we do not sell Personal Information in exchange for money, some of the ways in which we share Personal Information for advertising or marketing may be considered “sales” or “sharing” under California law. During the last 12 months, we have sold or shared for cross-context behavioral advertising the following categories of Personal Information:

  • Identifiers
  • Personal Records
  • Commercial Information
  • Internet Usage or Other Electronic Network Activity Information
  • Geolocation Data
  • Inferences.

We do not knowingly collect or sell the PI of persons under the age of 18. 

3. Retention of Personal Information

We keep the categories of PI described above for as long as necessary for the purposes described in this Notice or otherwise authorized by law. This generally means maintaining PI for as long as one of the following apply: 

  • The PI is reasonably necessary to manage our operations, to manage a Consumer’s relationship with us, or to satisfy another purpose for which we collected the PI;
  • The PI is reasonably necessary to carry out a disclosed purpose that is reasonably compatible with the context in which the PI was collected;
  • The PI is reasonably required to protect or defend our rights or property (which will generally relate to applicable laws that limit actions in a particular case); or
  • We are otherwise required or permitted to keep Consumer PI by applicable laws or regulations.

4. CALIFORNIA PRIVACY RIGHTS

We provide California Consumers the privacy rights described in this section. You have the right to exercise these rights via an authorized agent who meets the agency requirements of the CCPA and related regulations. As permitted by the CCPA, we will not fulfill your CCPA request unless you have provided sufficient information for us to reasonably verify you are the Consumer about whom we collected PI.

To make a request, please complete our data privacy request form or call us at 1-877-251-3497. If you choose to submit a request by phone, please provide the following information:

  • Your first and last name and, if you are acting as an agent for another individual, the first and last name of the individual who is the subject of the request and your relationship to that individual;
  • Contact information for follow-up, including a phone number or email address;
  • Your residential address; and
  • Explanation of your request related to your PI. 

In connection with submission of your request, we may need to take steps to verify your identity before action is taken. Please note that, if you submit a request to know, request to delete, or request to correct, we will take reasonable steps to verify your identity appropriate to the nature of the request.

A. Right to Know

You have the right to know what Personal Information we have collected about you and request, no more than twice in a 12-month period, for any of the following for the period that is 12 months prior to the request date:

  • The categories of PI we have collected about you;
  • The categories of sources from which we collected your PI;
  • The business or commercial purposes for our collecting, selling, or sharing your PI;
  • The categories of recipients to whom we have disclosed your PI;
  • The categories of PI about you that we disclosed for a business purpose in the prior 12 months, and the corresponding categories of recipients;
  • The categories of PI about you that we sold or shared in the prior 12 months, and the corresponding categories of recipients; and
  • The specific pieces of Personal Information we have collected about you. 

B. Right to Opt Out of Sales and Sharing of Personal Information

You have the right to opt out of the sale of your Personal Information, and to request that we do not share your Personal Information for cross-context behavioral advertising. If you are a California resident and would like to opt out of our use of your information for these purposes, you may do so by clicking on the Do Not Sell My Personal Information link on the bottom of our website. If you choose to use the Global Privacy Control (GPC) browser signal, you will need to turn it on for each browser you use.

C. Right to Delete

You may request that we delete your PI that we have collected directly from you and are maintaining, except to the extent we are permitted to retain your PI under the CCPA.

D. Right to Correct Inaccurate Information

If you believe that Personal Information we maintain about you is inaccurate, you have the right to request that we correct that information.

E. Non-Discrimination

You have the right to not receive discriminatory treatment for exercising your CCPA privacy rights. We will not discriminate against you in a manner prohibited by the CCPA because you exercise your CCPA rights.  

5. ADDITIONAL CALIFORNIA NOTICES

California’s “Shine the Light” law permits California residents to request certain information regarding our disclosure of PI to third parties for their own direct marketing purposes. We do not share personal information as defined by California Civil Code § 1798.83 (“Shine the Light” law) with third parties for their direct marketing purposes.
